I spent eight years interpreting a Canadian statute – the applicable paragraphs of the Immigration and Refugee Act, as it then was (1998-2006).
That involved preparing for a hearing with a refugee claimant and their legal representative, presiding, and issuing a decision based upon the facts of the case, the country literature, applicable treaties and conventions, maxims of the law, procedures of the Immigration and Refugee Board (IRB), etc.
Even so, I was what the IRB called a community member, not a legal member. I don’t consider myself either an expert in the law or for any other reason qualified to comment on the law.
Nevertheless, spirituality has much to do with our legal relations and it’s really that that I want to speak to.
I want to take what I hope is a spiritual perspective on the law.
For me, the most important task of laws is to govern the boundaries of acceptability in interpersonal relations. They involve situations where harm from my action may result in harm to you.
I’m not focusing on harm only to ourselves. That’s an area of the law I have no knowledge of.
The spirituality that I’m aware of has two areas relevant to law in general: (A) The applicability of the universal laws and (B) the spiritual goal and nature of the law in question.
We could hold learned commissions for years and I still think that, at the end of it, we’d agree that the basis of all human laws, to be spiritual, would have to be their foundation in (A) love and (B) fairness.
Problems arise with that statement however. One is that I’m not talking about what passes as “love” in our society. I’m talking about a higher form of love which we’re told we’ll soon know but may not know yet. (1)
Two is the problem of getting a whole society to switch interpersonal communication from what it is, all too often, a foundation, especially in legal and political settings, in self-serving justifications, excuses and denials to one of love and fairness.
That has been the stumbling bock up until now in my opinion: People are reluctant to drop what is familiar to them – a communication system based in being right and looking good.
The rising vibrations will at some point mean that only those who accept love and fairness will go on with us. A division will have been made; timeliness will diverge; (2) and we will experience a consciousness shift that will make our discussion of law largely superfluous. (3)
Our discussion concerns the time between now and then.
My attention is drawn more to love and fairness than to the universal laws right now. That may change in the near future when I do a compilation of writings on the universal laws as part of GAoG’s Basic Library.
